At least 25 years consecutive description about the transferred land:- The details of the succession and the earnest money deed in the applicable matter and the purpose of the transfer,  possession of the property, isment and the mentionable opinion about the transferred property (if any):  Remembering the name of merciful Allah it is being started to describe this lawful deed, when the husband of the  deed giver namely Mr. Khandaker Jakaria Mahmud applied  to RAJUK for a plot allotment of Gulshan Residential Area  under the lay-out plan of Rajdhani Unnayan Kartipakkha (RAJUK), RAJUK allotted a plot no.-3/A, road no.-84, block no.-NE(L) under Gulshan Residential Area on the power of the memo no......................., date:.........................according to his application to RAJUK. As Mr. Khandaker Jakaria Mahmud paid all installments in against of the said plot to RAJUK, the authorities of RAJUK marked the plot physically and handed over the plot to him and RAJUK leased the plot to Mr. Khandaker Jakaria Mahmud through registering a lease agreement deed no.-4107 in Gulshan Sub-Registry Office on the date of 07/08/1992. Then, being owner of the scheduled property and next taking the permission from the related authorities Khandaker Jakaria Mahmud  donated the plot to his wife  through registering a deed of donation no.-17 on the date of 01/11/1992 and then said Khandaker Jakaria Mahmud left all kinds of ownership from the schedule land. Being owner of the scheduled land through the power of the deed of donation I “deed possessor” applied to RAJUK on the date of 09/10/1993 to mutate my name for paying the rent  and then RAJUK  gave the permission to mutate my name  through the memo no.-RAJUK/Estate/850 on the date of 02/03/1994. Accordingly I filed the separation and mutation case no.-4546/95-96 on the date of 04/09/1995 to Assistant Commissioner (Land), Circle-Tejgaon and paying the government rent and tax I have been enjoying the scheduled land peacefully.  When I was enjoying the land, I passed the plan through the memo no.-RAJUK/NAA-R3C-1105/05/1249, Establishment on the date of 22/09/2008 for the purpose of constructing a multi-storied building on the schedule land.  Accordingly constructing a 6 (six) storied building in the jot no.-61/22 I have been paying the rent and tax and submitting the cheque and enjoying the property peacefully even today.

 

At present being needed the cash money due to legal reason, I proposed to sell the scheduled property and getting my proposal you “deed receiver” have been willing to purchase the property. Accordingly, when I prayed to me on the date of 05/11/2014 to hand over the flat to you, I applied to RAJUK to give permission for handing over the said flat to you. Then RAJUK gave me the permission  though the memo no.-RAJUK/Estate-1/Gul/NE(L)-84-3/A/5042, date: 12/11/2014 after depositing the  transfer fee and documentation fee.  Accordingly I deposited Tk.3,02,504/- as transfer fee through M,R No.-15448 on the date of 01/12/2014 and I deposited Tk.3,100/- as documentation fee  through M,R No.-50175 in Janata Bank, RAJUK Corporate Branch, Dhaka. When I deposited the said two receipts to RAJUK, RAJUK gave me the permission through the memo no.-RAJUK/Estate-1/Gul/NE(L)-84-3-A/5456 on the date of 09/12/2014.  After getting the permission to transfer the deed property I have sold the property/flat to you in the presence of the witnesses.  The possession, right and ownership which were on the said property/flat, will be vested on you “deed receiver”. Handing over the property to you “deed receiver” I “deed giver” and my all successors have left all kinds of ownership from the scheduled land forever.

 

From this date you “deed receiver” can  enjoy the property being owner of the property according to this absolute sale deed.  In this matter, I “deed giver” and my all successors can not make any claim and objection and others excuse, etc.  If such claim or demand is made, will be rejected and disallowed in the all courts.  If any kind of error, mistake are revealed in the future about the below mentioned property, I “deed giver” and my all replaced successors will be liable to register the  rectified deed willfully.  The below mentioned property has not been transferred, sold in the previous time or any kind of donation, sale, mortgage, cot, heba, transfer about the said property have not been made with the others persons. Any kind of earnest deed or verbal promise have not made about the property in the previous time. Besides this, it has not be taken any loan mortgaging the land to any person.  The scheduled mentioned property has been sold to you “deed receiver” without any problem, fake and free from any error and then I have marked the property and have handed over the possession to you.

 

From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

 

You “deed receiver” will have the power  to use jointly the entering way, stair, roof, electric meter, out going way, overhead, underground, water tank, gas, electric, water and sewerage line etc and  the repairing work will be operated jointly with the others flat’s owners and you has to bear the expense at the proportionate rate.  In this matter any person can not make any objection.

 

Whereas, the deed receiver will be liable to follow the rules and conditions of original lease deed  in the all time.

The plot will be undivided and unchanged i,e- the plot will not be divided in any how.

The plot will be enjoyed by all transferees jointly. If it is needed to construct a building in the future, the conditions of the lease deed will be followed.

Lessee can not make any damage in the stricture of the flat or in the plot based on the flat construction on the plot. If he does so, this lease of the flat will be cancelled in any time.  Otherwise,  the all conditions of the original lease deed will be vested on the  transferee of the flat.

The below mentioned scheduled property was purchased by Md. Mojibor Rahman and others through registering an absolute sale deed no.-11030 on the date of 30/12/1986 from R,S recorded owner namely Md. Jabed Ali and others,  through registering an absolute sale deed no.-11032 from Firoza Khatun and others,  through registering an absolute sale deed no.-2410 on the date of 20/02/1997 . Then being owner of the scheduled property he sold the said property to M/S. East-West Properties  through registering an absolute sale deed no.-951 on the date of 15/07/2001 and he left his ownership from the scheduled land. When Kadban Bibi, Julekha Bibi and Rabina became owner of the scheduled land according to the fatherly successors, they recorded their names in R,S record correctly.  When they were enjoying the scheduled land, Kadban Bibi and Rabia Khatun died. After their death, Shajahan became the owner of the property according to the  successor of Kadaban Bibi. Then being needed the cash money  he sold the property with Julekher Bibi through registering an absolute sale deed no.-8532 on the date of 27/06/2001 to Hajee Md. Abdul Kadir Dargee and others  and from that time, Shahajan left all kinds of ownership from the scheduled land. Being owner of the scheduled land by  Md. Abdul Kadir Darjee according to the purchase and fatherly successor, he sold the property through registering an absolute sale deed no.-13721 on the date of 27/10/2003 to M/S. East-West Property Development (Pvt) Limited and he left all kinds of ownership from the schedule land.  Then  being owner of the said land including others land  according to two absolute sale deeds M/S. East-West Property Development (Pvt) Limited prepared  a residential project namely “Basundhara”. Then M/S. East-West Property Development (Pvt) Limited  sold the property to me ‘deed giver”  through registering the absolute sale deed no.-14946, date: 24/06/2007 and absolute sale deed no.-27944 on the date of 19/11/2007 in Gulshan Sub-Registry Office and then the company left all kinds of ownership from the land.  Being owner of the schedule land I ‘deed giver’ has filed the mutation and separation case no.-1852/12 and 1853/12, date: 19/07/2012 to the Assistant Commissioner (Land) Cantonment Circle and in this way I have separated and mutated my name in the jot no.-24/140 and 31/140. From the date, paying the government rent and tax and submitting the cheque I “deed giver” have been enjoying the schedule land peacefully.

 

At present being needed the cash money I “deed giver” have proposed to sell the below mentioned scheduled land. Getting my proposal you “deed receiver have been agreed to purchase the scheduled land. Discussing about the market value of the said land with you, both of us have decided that the market value of the said land will be Tk.2,32,42,000/- (two crore thirty two lacs and forty two thousand taka). Taking the money of Tk.2,32,42,000/- (two crore thirty two lacs and forty two thousand taka) from you “deed receiver” I “deed donor” have sold the property to you “deed receiver” by the absolute sale deed and handing over the possession of the said land to you ‘deed receiver”. I and my all successors have left all kinds of ownership from the land forever. From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

 

It is being mentioned that I “deed donor” have not sold the below mentioned scheduled property even before, can not transfer, can not donate, can not mortgage and can not make any agreement with others by writing or by verbal. I can not mortgage the property to others or to any bank and I can not make any earnest money deed with others and the scheduled property has not been made auction and has not been forfeited. If in the future I and any of my successor make bar to live in the land peacefully or make any kind of disturbance, we shall be convicted by law. Even we shall be liable to refund your purchased value including giving the compensation. If the matter is not be settled,  you can get relief according to law. The property has been sold to you without any problem, disturbance and mistake.

 

If any kind of misleading or secreting of correct information about the  interest, possession of the transferred land are revealed in future and for this, any kind of loss is occurred, I “deed donor” shall remain accountable to refund the showed value including the compensation and I shall be convicted for this according to law.

 

 It is being mentioned that, if any kind of error is revealed in future or if it is needed to register the rectified deed regarding to the heba declaration deed as well as schedule property, I “deed donor” and my all kinds of successors will be liable to register a rectified deed without any objection and excuse.

The description of the proposed immoveable property has been given correctly for the transfer and  the less value of the property has not been  made and  the applicant has the right to transfer the property.

 

I am also declaring that, I am the absolute owner of the schedule property.  I have not made any earnest money deed with others about the property and I have not transferred land and I have not mortgaged the property.
