At present as we have been enjoying the scheduled property according to the successors of them, we are executing this deed of compromise in the presence of the local respective persons and our close relatives so that any kind of dispute cannot be risen in the future among our children and successors about the possession of the said property. Beside this, as there is a provision of the country law to separate and mutate the property among the owners and our close relatives and local respective persons have advised us to separate the property, we have executed this deed of compromise. The deed giver purchased the land from  Bibi Kolimon Nessa  by the sale deed no.-26 on the date of 4.1.27. Jot number of the property is 3462 which is recorded on 22.10.27. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

At present being needed the cash money I “deed giver” have proposed to sell the below mentioned scheduled land. Getting my proposal you “deed receiver have been agreed to purchase the scheduled land. Discussing about the market value of the said land with you, both of us have decided that the market value of the said land will be said amount. Taking the money from you “deed receiver” I “deed donor” have sold the property to you “deed receiver” by the absolute sale deed and handing over the possession of the said land to you ‘deed receiver”. I and my all successors have left all kinds of ownership from the land forever. This deed has been registered on 13th Baishak, 1376 BS correspondence to 26.4.69AD.  Schedule of the Property: District: Dhaka, Municipality and PS: Kotowali, Mowza No.-93 Old Kasba, its owner is Assistant Commissioner of Land on behalf of Bangladesh Government, Area of land: 36 decimal. Its rent is 5.00 taka. Area of land 03 decimal and its rent is 56 paisa and Khatian No.-1302/1 and plot no.-1362/1625. It is being mentioned that I “deed donor” have not sold the below mentioned scheduled property even before, have not transferred, have not donated, have not mortgaged and have not made any agreement with others by writing or by verbal. I have not mortgaged the property to others or to any bank and I have not made any earnest money deed with others and the scheduled property has not been made auction and has not been forfeited.  The below mentioned scheduled property has been sold by absolute sale deed when the property was correct without any error and without any liability. If any kind of error in the absolute sale deed is revealed in future, the deed will not be rejected or will not be abolished. Rather, if it is needed, I shall remain liable to execute and to register a new rectified deed under my responsibility and the error rectified deed will be considered as part of the absolute sale deed. The said property has not be made requisition or it is not under the acquisition. It is not any vested property. I have not sold the property in the previous time or I have not made any earnest money deed about the land or I have not made any agreement about the land.  There is no co-sharer in the land. The schedule land has been sold to you without any disturbance, problem and without any error through this absolute sale deed.  If it is revealed any kind of dishonesty in future about the sold land and for this you “deed receiver” falls into trouble, it will be convicted according to the current criminal law and I “deed donor” shall be liable to return you your all kinds of paid money to me including the compensation. Also my related successors will be liable to give the compensation. The value of the Second Party’s Property is Tk.6,000/- and the value of the Third Party’s Property is Tk.4,000/- .

Our father Late Abdul Gafur Sarkar came from the East  Pakistan during the former East Pakistan period and started working as a shop in the plot of land belonging to Jessore and Khas mines of Khas non agricultural land under lease of Shahjahan under the poverty line of Jessore Municipality. If our father Abdul Gafur Sarkar dies, our family members are unanimously enrolled in the case of the Deputy Commissioner of Jessore, 25 / X / 82-83 and Lease Case 32 / X / 82-83, in view of the application in favor of Abul Kashem Sarkar. The lease was ordered by the name of Abul Kashem Sarker and the payment of the lease was made by D.C.R. Abul Hassan's government agreed to separate it from family joint family by adopting a family compromise. And in the registered land, 7 (seven) became a partner in the share of the brother's brother, and we applied for the two applicants as Abul Kashem Sarker and Abul Hasan Sarkar as a joint applicant for the last term in the non-agricultural land.

 

On 06/09/2000, we filed two applications jointly with Jessore District Commissioner for getting the lasting bond of non-agricultural land in our business located at the bank of the Garibshah Road in Jessore Municipality.

 

The application was made in two names for obtaining long term settlement of government non-agricultural Khas land of 72 square feet of 75 marks in the Jessore mouza of 80 no. Of this petition lease case- 25 / X / 82-83 document. There are 45 bighas of land in New Hasan Book Depot in the eastern part of the Garhshah Shah Road, Dartana Burdh, within 72 bighas of the said application. Whose sole owner Abul Hassan Sarkar (part of the land is owned by Abul Hasan Government), which is accepted by Declaration on the date of 03/09/1993, memo no.-Uma-6318708 = Tk.50/- (Acknowledged by Stamp Declaration).

On the western side, the remaining 27 sq ft of land is in Hasan Book Depot, Hasan Book Depot No. 275 / X. /11/ 59-60 which is owned by Abul Kashem Sarker and Abul Kalam Sarker. 2 (two) establishments have been separated by the brick wall of the building between the 2 (two) institutions New Hasan Book Depot and Hasan Book Depot. The rugged wall is the equal partner on both sides. If the long pending settlement of non-agricultural land is leased out of the total of 72 square feet of the application, the land of its share will be acquired as a property for itself. We will bear all the rent and related expenses of our respective areas. For business or personal needs, we can change the name or organization of the organization. Without the permission of anyone, I can not remove or overcome the middle wall of the two organizations.

 

And 2nd application lease case 33 / X / 82-83 document, Mowza No.-92, Plot no. 322,  total size: 2178 square feet, in the name of the name of the government Khas for the long term lease agreement of non-agricultural land for getting the settlement of the name of our two names namely Abul Kashem Sarkar and Abul Hasan Sarkar, Jessore Deputy Commissioner Has been applied. A total of 783 bighas of land between Hasan Ali and Mason's, etc., Whose sole owner Abul Hasan Sarkar (115 acres of land in the 783 brackets of land is entitled to the land of Abul Hasan Government as part of the warships and the remaining 668 bighas of land are owned by the Abul Hasan Government from the north side) and on the south side there is 1395 sq ft of Hasan Brothers and Malhiha Stationery. Answery  Parsby Hassan and Kong and etc. and the parts of two (two) people separated from the brick wall between Hassan Brothers and Malhiha Stationery on the south side. Hassan Brothers and so on 12-feet long east-west and 13-ft tall brick wall on the south-north side are equal partners on both sides. And then between Hassan Brothers and Hassan & Kong, the East-West 33-footed brick wall, whose sole owner Abul Kashem Sarkar (there is no part of Hasan and Co. on this wall). If the provision of 2178 square feet of the government's non-agricultural land has been settled, then the land on which they own the land will be acquired as their own property. We will bear all the rent and related expenses of our respective areas. In business or personal need, we can change the name of the organization or anusangak. No one can remove or interfere between the two companies without permission.

Our successors will enjoy the property separately  during joint names of the leased property. In this circumstance, any successor will not be liable for this. It will be rejected in all acts. The said land will not be transferred in anyhow. If there is any opportunity to separate  the leased land according to the rules of allocation, the both parties will utilize it appropriately.
