Remembering the name of merciful Allah it is being started to describe this lawful deed, when the husband of the  deed giver  applied  to RAJUK for the allotment of Uttara Residential Area  under the lay-out plan of Rajdhani Unnayan Kartipakkha (RAJUK), RAJUK allotted the property by LA Case no.-64-65.

 

As the deed giver paid all installments in against of the said property to RAJUK, the authorities of RAJUK marked the plot physically and handed over the property to him and RAJUK leased the plot (size: 416 square gauge) to Mrs. Hasna Banu in  the plot no.-07, road no.-08, section-07 in Uttara Residential Area.

 

Then I “Deed Giver-Mrs. Hasna Banu” deposited the money to the concerned authorities after getting the allocation the plots from DIT, at present-RAJUK and then I deposited  the all installments through the bank receipts in RAJUK Building Branch.

 

Then DIT, at present-RAJUK has handed over  the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area to the deed giver-Mrs. Hasna Banu and the deed giver took the possession of the plot from RAJUK.

 

 

 

 

 

 

 

 

When the deed giver applied for the registration and execution the lease deed, DIT, at present-RAJUK  on behalf of Bangladesh Government executed and registered  a lease deed no.-1225, page no.-107-119, volume-38, book-1 on the date of 12.04.1983 in Sadar Sub-Registry Office, Dhaka and in this way, RAJUK executed and executed  the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area to Deed Giver for 99 years.

 

After getting the allocation of the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area from DIT, at present-RAJUK  on behalf of Bangladesh Government I “Deed Giver” have been paying the rent and tax and submitting the cheque and enjoying the property peacefully even today. Then the deed giver  executed  an agreement of two parties  with Asset Development & Holding Limited to construct a multi storied building  on the scheduled land.  Then I applied to RAJUK to construct a multi storied building on the said land. After getting our application RAJUK gave us approval or passed plan to construct a 6 storied building on the scheduled land.  According to the joint venture with the developer company we took connection of gas, water, electricity, sewerage line in the building and then I “Deed Giver” have been paying the rent and tax and submitting the cheque and enjoying the property peacefully even today.

 

At present I “deed giver” have took decision to hand over my property “There is total 416 square gauge of land in 07 No. Section, Road No.-08, Plot-07 in Uttara Residential Area under  Dhaka Improvement Trust (DIT), at present-RAJUK. A 6 (six) storied building has been constructed on this land. With 0085.80 ajutangsha of land with the common facilities, a car parking space in the gourd floor and the flat no.-A-1 (size: 1571.36 square feet in the south east side) in the 1st floor”. Accordingly I have deposited the transfer fee of the 4 flats within 01 month according to the instruction of RAJUK.

 

 

 

 

 

 

 

 

When I applied to RAJUK to hand over my property to the deed receiver and accordingly I have paid the transfer fees in the Janata Bank, RAJUK Building and deposited the copy of deposition, RAJUK has given me permission to handed over my property on favor of deed receiver through the RAJUK memo no.-RAJUK/Estate/6073 Est: date: 22.08.2010. The value of the property is Tk.11,77,884/-.

 

You “deed receiver” are my uterine daughter. At present I have been old.  Nobody can not say when what will do. In my old age condition, you “deed receiver” have been taking care and respecting me for a long time. So, being satisfied to your love and affection, respect I “deed donor” have been decided that I have donated some of my property to you. In the presence of the witnesses and local people getting holy Qurean from you I “deed donor” have executed this deed of donation on the favor of you “deed receiver” for the scheduled property on the date of 03.09.2010 and  from this date I “deed donor” have left all kinds of ownership from the scheduled property. 

 

 

I “deed giver” have handed over the land verbally  to you according to Islamic Sharia  as a result of love and affection and I have not given to you any written deed about the schedule land. This is why, it may rise any problem from my successors and it may create any registration problem and mutation problem in the concerned land office in the future. Beside this, it has been made mandatory to register any verbal donation, I have executed this heba declaration on favor of you to resolve the various problems in the future and by this, I have recognized my verbal donation through this registration and  from this date I “deed donor” have left all kinds of ownership from the scheduled property  though handing over the property to “Sabina Islam, Husband: Sorif Uddin Khan, Father: Late AKM Towfiqul Islam, Mother: Mrs Hasina Banu, Address: Flat no.-A-1, House-07, Road-08, Sector-07, Uttara Residential Area (100%).

 

 

 

 

The below mentioned scheduled property has been sold by absolute sale deed when the property was correct without any error and without any liability. Handing over the possession of the said land to you ‘deed receiver”. I and my all successors have left all kinds of ownership from the land forever.

 

From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

 

RAJUK  on behalf of Bangladesh Government executed and registered  a lease deed no.-1225, page no.-107-119, volume-38, book-1 on the date of 12.04.1983 to Deed Giver for 99 years. It is being mentioned that I “deed donor” I can not make any earnest money deed with others and the scheduled property has not been made auction and has not been forfeited.  The below mentioned scheduled property has been sold by absolute sale deed when the property was correct without any error and without any liability. If any kind of error in the absolute sale deed is revealed in future, the deed will not be rejected or will not be abolished. Rather, if it is needed, I shall remain liable to execute and to register a new rectified deed under my responsibility.

 

If any kind of mistaking is revealed in the plot no., khatian no. or description or in the question of the ownership on the below mentioned schedule land, this deed will not be rejected. Rather I “deed donor” and my any of replaced successor will be liable to rectify the mistaking from the deed. If it is necessary to register a new deed, I “deed donor” and any of my replaced successors will be liable to register a new deed.
