6. Description of the attorney:

Power of attorney giver: Soyed Habibullah.

Power of attorney receiver: Chairman & Managing Director-Md. Abdur Rahim Khan on behalf of Index Development Limited.

Deed Number, date and office: 22246, date: 19/12/2005AD. Sub-Registry Office: Gulshan, Dhaka.

 

7. At least 25 years consecutive description of the transferable property and description of the earnest money deed when it will be applicable:-  RAJUK published the advertisement  to give allocation of the plots in Uttara Residential Area according to the lay out plan. Then the deed giver applied to RAJUK to get the plot allocation through depositing the security money. Then RAJUK gave the allocation of the plot no.-34 (area: 5 kathas or 0825 ajutangsha in the local measurement)  at 13 no. Section, Shah Mukdum Avenue  by dint of the memo no.-RAJUK/Estate/1567P: on the date of 09/05/1990.

 

When the deed giver paid the value of the allocated plot to RAJUK, the deed giver was handed over the plot on the date of 08.02.1994 and the plot was handed over to the deed giver.

 

When the deed giver applied for the registration and execution the lease deed, RAJUK executed a lease deed on the date of 23/12/1995 and registered  a lease agreement no.-4703 on the date of 20/04/1996 in Gulshan Sub-Registry Office which will be valid till 99 years and it will be renewed for the next time.

 

Being owner of the scheduled land the deed giver filed the separation and mutation case no.-10152/02, date: 10/07/2002 and accordingly he separated and mutated the jot no.-105/33 and accordingly he has been enjoying the government rent and tax.

Then the deed giver  executed  an agreement of two parties  on the date of 19/12/2005 with the Md. Abdul Rahim Khan on behalf of Index Development Limited to construct a multi storied building  on the scheduled land. To implement the conditions of the agreement of the two parties the deed giver executed a power of attorney deed no.-22246 on the date of 19/12/2005 in Gulshan Sub-Registry Office on favor of Md. Abdur Rahim Khan, chairman and managing director  of Index Development Limited.

When it was applied to get the permission for appointment of the power of attorney to RAJUK,  Assistant Director (Estate), RAJUK  gave the permission to appoint a attorney to Md. Abdur Rahim Khan, Chairman and Managing Director  on behalf of Index Development Limited  to operate the all kinds of development activities  on the scheduled plot by dint of the memo no.-RAJUK/Estate/169Establishment  on the date of 06/03/2006.

Then I “deed executor” passed a plan from RAJUK by dint of memo no.-RAJUK/TDA/3C/796/06/1636 Establishment on the date of 17/10/2006. Then constructing a six storied building on the scheduled land I “deed executor” took the gas, water, electricity, sewerage connection and then I handed over the receivable share to the said deed giver.

 

At present being needed the cash money  I “deed giver” declared to sell the scheduled property/flat. Getting this news you “deed receiver” have been willing  to purchase the scheduled property in Tk.27,76,000/-. When I “deed giver” asked for the permission to RAJUK to sell/transfer the flat in the highest market value, RAJUK  gave me the permission to transfer/sell the flat  through the  memo no.-RAJUK/Estate/Uttara/944 Establishment  on the date of 03/02/2015 and for this purpose the deed giver was instructed to pay the  transfer fees, service charge  and then it is also instructed to  deposit the bank receipt  to RAJUK, Janata Bank Limited, Uttara Corporate Branch, Dhaka.

 

When the bank receipts were submitted to RAJUK  after depositing  the transfer fee, service charge  to Uttara Corporate Branch, Dhaka in Uttara Bank, RAJUK became satisfied to the said deed giver and then RAJUK gave the permission to transfer the property/flat to the deed receiver  by dint of the memo no.-RAJUK/Estate/(Uttara)/1181 (3) Establishment on the date of 16/02/2015.

 

After getting Total value of Tk.27,76,000/- in the presence of the witnesses I “deed executor” have handed over the scheduled property to the deed receiver and from the said, I “deed giver” and my all successors have left the ownership from scheduled land.

From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

 

It is being mentioned that I “deed donor” have not sold the below mentioned scheduled property even before, can not transfer, can not donate, can not mortgage and can not make any agreement with others by writing or by verbal. I can not mortgage the property to others or to any bank and I can not make any earnest money deed with others and the scheduled property has not been made auction and has not been forfeited.  The below mentioned scheduled property has been sold by absolute sale deed when the property was correct without any error and without any liability.

 

If any kind of mistaking is revealed in the plot no., khatian no. or description or in the question of the ownership on the below mentioned schedule land, this deed will not be rejected. Rather I “deed donor” and my any of replaced successor will be liable to rectify the mistaking from the deed. If it is necessary to register a new deed, I “deed donor” and any of my replaced successors will be liable to register a new deed.

 

Whereas, the land of the plot will be undivided, unchanged and unmarked position, at any rate the plot will not be divided. The deed receivers can not damage the plot or structure of the deed receiver’s flat  by dint of this transfer deed.

 

Whereas, you “deed receiver” will be liable to follow the all instructions of  “Susma Index” Flat Owner’s Association and will pay the regular toll and  service change. The joint users of the building will keep the undamaged position of the space. At any rate the design of the inside and outside  of the building will not be changed.  The owners of the flats in the building will keep the good relation to each other. If any kind of problem raised among the residents,  the problem will be solved  through   “Susma Index” Flat Owner’s Association.

 

Whereas, the conditions and rules which were described in the lease deed no.-4703 registered in Gulshan Sub-Registry Office on the date of 20/04/1996 will be vested on the deed receivers. The deed receivers will be liable to follow the all conditions.
