Earnest Money Deed of Agreement

It is being started to describe the earnest money deed for sale by the name of Allah. I “deed giver” am the owner of the land which scheduled are as follows:- Khatian No.-1909, District: Gazipur, Upazila: Gazipur Sadar, Mowza: Baraipara, JL No.-04, recent SA Khatian No.-402 and RS Khatian no.-877, Jot no.-3840. There is area of land 16 acre 97 decimal.  Khatian No.-1946, District: Gazipur, Upazila: Gazipur Sadar, Mowza: Baraipara, JL No.-04, recent SA Khatian No.-402 and RS Khatian no.-877, Jot no.-3873. There is area of land 5 acre 70 decimal.   Total area of land: 22 acre 67 decimal which will be sold.

Being owner of the land, I “deed giver” have paid the government  rent and tax on the land and were enjoying the land peacefully. At present I need money to pay my loan and to carry my family expense and for this, I have proposed to sell the below described property and getting my proposal you “deed receivers” have been willing to purchase my land. The highest present market value of the land has been assessed Tk................./- (twenty one lac) and taking the advance money of Tk.........../- (in word:..........) from you  I “deed givers” have executed the earnest money deed before the witnesses.

 

It is being mentioned that, hereby it is being given affidavit that, I/We are the absolute owners of the transferred land. It is not signed any agreement or earnest money to others parties or it has not been sold to others parties or it has not been mortgaged to the others parties. It is not a khas/vested/rejected properties of the government or it has no ownership of the government in anyhow on the properties. I am also promising if any information (above mentioned) is wrong, I shall remain accountable for this and in this matter it will be done the criminal and civil case against me/us. If any wrong and untrue information is given about the transferred properties, I shall remain accountable to rectify it and I shall also remain accountable to prepare and to register a new deed by my own cost.

Taking the rest money of Tk. .................../- (in word: ) within 3 (three) months I “deed giver” shall register the absolute sale deed to you “deed receivers” or any of your representative. If you “deed receiver” paid the due money in the due time or you are willing to pay the due money of the sale deed, but I “deed donor” don not take the money or I become lazy to register the absolute sale deed, you “deed receiver” can present the earnest money deed in the court and can register the deed. In this matter all kinds of expense of court will be carried by me “deed donor” and hereby I shall be liable. If you “deed receiver” fail to pay the rest money of the sale deed lawfully, the earnest money deed will be rejected and ineffective and the earnest money will be forfeited.

 

Hereby making others write the earnest money deed and making others read the deed and understanding the summary of it and taking the value of advance money deed Tk............../- (.........), in my own willing, in my common sense and without any instigation of others I “deed giver” have signed on the earnest money deed before the witnesses. End. Date: 28/12/04AD.

 

The said deed has been composed in 3  pages by computer and there are 3 witnesses in this deed.
