It is being started to describe the earnest money deed for sale by the name of Allah. As the owner of the schedule C,S, recorded land is Razu Sheik. In the next time the property was recorded in S,A record correctly in the name of the 2 (two) sons of Harun Rashid alias Harun Mollah including others. The two sons of Harun Mollah named Sumsuddin and Abdus Jabbar were enjoying the property of S,A record  with their mother and niece, they sold  total 26 (twenty six)  decimal of land by registering the two absolute sale deeds no.-3692 and 3693 (13 (thirteen) dicmil land in the each sale deed) on the date of 05.05.1962 to my mother Mst. Momotaj Begum and my father- Solim Uddin.

 Being owner of the land my father and mother were paying the rent and tax on the land and were enjoying the land peacefully. My father and mother divided the said land into 4 (four) plots on the date of 7/8/1989 and prepared the papers and map of the plots and then my father kept one plot in his own name and donated the others plots to 3 (three) of my sisters. The plot no.-2 (601 ajutangsha or 2618 squire feet) was handed over in my name and the others 3 (three) plots were in the name of my father (1 plot) and 2 (two) plots were transferred in the name of my 2 (two) sisters. Being owner of the land I “deed donors” have been enjoying the land without any instigation of others. To live comfortably in the said land and to get a road and to run on the road I “deed donor” have given some land from my plot in the west and south side.

 

 At present I need money to pay my loan and to carry my family expense and for this, I have proposed to sell the below described property and getting my proposal you have been willing to purchase my land. The highest present market value of the land has been assessed Tk. 21,00,000/- (twenty one lac) and taking the earnest money of Tk.6,00,000/- (six lac) from you  I have executed the earnest money deed before the witnesses.

Taking the rest money of Tk. 15,00,000/- (fifteen lac) within 3 (three) months I “deed donor” shall register the absolute sale deed to you “deed receiver” or any of your representative. If you “deed receiver” paid the due money in the due time or you are willing to pay the due money of the sale deed, but I “deed donor” don not take the money or I become lazy to register the absolute sale deed, you “deed receiver” can present the earnest money deed in the court and can register the deed. In this matter all kinds of expense of court will be carried by me “deed donor” and hereby I shall be liable. If you “deed receiver” fail to pay the rest money of the sale deed lawfully, the earnest money deed will be rejected and ineffective and the earnest money will be forfeited.

It is being mentioned that, hereby it is being given affidavit that, I/We are the absolute owners of the transferred land. It is not signed any agreement or earnest money to others parties or it has not been sold to others parties or it has not been mortgaged to the others parties. It is not a khas/vested/rejected properties of the government or it has no ownership of the government in anyhow on the properties. I am also promising if any information (above mentioned) is wrong, I shall remain accountable for this and in this matter it will be done the criminal and civil case against me/us. If any wrong and untrue information is given about the transferred properties, I shall remain accountable to rectify it and I shall also remain accountable to prepare and to register a new deed by my own cost.

Hereby making others write the earnest money deed and making others read the deed and understanding the summary of it and taking the value of earnest money deed Tk.6,00,000/- (six lac) by  pay-order no.-23/39/8, date: 27/12/04 under Oriental Bank, Mirpur Road Brunch, Dhaka, in my own willing, in my common sense and without any instigation of others I “deed donor” have signed on the earnest money deed before the witnesses. Schedule of the earnest money deed’s property

District: Dhaka, previous-Tejgaon, recent: Mirpur, under P.S. & Sub-Registered Area, Tewje no.-423, Mouza no.-220, name: Shanpara, Parbata, C,S, Khatian no.-173, C,S & S,A Plot no.-1479, the next Khatian no.-3361/1, Plot no.-9146, total land-26 decimal and 601 ajutangsha or 2618 squire feet land has been sold under it and hereby the earnest money deed has been executed. In the north: Abul Kashem, House no.-980/2, In the south: 16 feet road (less or more), next house of Fazlul Haque, house no.-969, In the East-5 feet road, next house no.-978 and in the west- road no.-10 feet, in the next-982/1 no. house and its owner is  Mrs. Nargis Banue.  In that boundary- East Monipur, P.S.- Mirpur, Dhaka-1216. 601 ajutangsha or 2618 squire feet land has been on earnest money deed in this boundary.

 

The said deed has been composed in 4 (four) pages by computer and there are 4 witnesses in this deed.

I am Solim Uddin Ahmed, Father: Late Shofiqule Ahamed Miah and  I am Begum Momotaj Shelim, Husband: Solimuddin Ahmed, both locality- 304 Sher-E-Bangla Road, Rayer Bazar, P.S.- Mohammadpur, District: Dhaka. Age serially-78 years and 68 years, Nationality: Bangladeshi, Religion: Islam, Occupation: Retired government officer and housewife, hereby it is being declared that,

I am the owner of the blow mentioned scheduled land, District: Dhaka, previous P.S.-Tejgaon, Mouza-Shippur, previous owner- Binod Bihari Pul son of  Bipin Bihari Pal. I have been owner of the land of 0.2390 acre (14 kathas) by the two absolute sale deed no.-22466 and 22467 on the date of 23/11/1967 according to the purchase. Then I have issued my on name on the land and paying the government rent and tax on the land I have been enjoying the land without any objection of others.

Getting the approval of plan from D,I,T (at present RAJUCK) I have constructed the 3 (three) storied of building on the 6 kathas of land and its holding number is 304.

On the date of 30/11/88 and on the date of 28/12/88 the two allotment deeds have been attested before the Notary Public and the total property (holding on.-304) of us have been divided among  our 4 (four) sons and 3 (three) daughters. The flat (in the underground) in the south side on the holding no.-304 has been allotted to my elder son named Khalid Salim and  the flat (in the underground) in the north side has been allotted to my second son named Alamgir Salim and the flat (in the south side and in the 1st floor) has been allotted to my third son named Towmur Salim and the flat (in the north side and in the 1st floor) has been allotted to my 4th son named Musa Salim. The deponent no.-2 (Momotaj Begum in the west side) has been enjoying the 2 flats in the 2nd floor (in the north side) of the said house. In the next time, the two small flats were constructed in the 2nd floor (in the south side) under Schedule-B and both of us “husband and wife” have been enjoying the possession of the said flats.

.06 decimal of land has been donated to the each daughter of us in Murpur Shonapara by the said “allotment deed/ deed of will”. For this, our third daughter named Murshida Nuzhat (Naz) has been owner of the 0.06 decimal of land.

5.

We have made our all sons marry. They are living with their wife and children with happiness. We have made our all daughters marry. Our 1st daughter and 2nd daughter are living peacefully with their children in their husband family. Our third daughter namely Murshida Nuzhat married Mr. Dr. Bazzlur Rahman, Father: Mohin Uddin of Chakderpara, P.S.- Nowga, District: Nowga on the date of 20/4/85 and he got birth a son in the said family life and her son name is  Soyaj Morshed, age-8 years. After giving birth the son there was a dispute in her family life. For this, they divorced each other on the date of 1/2/89. After the divorce our daughter have been living in our family with her son.

6.

In this age we have been old aged and we are affected with diseases. Nobody can not say when, what will be got in a man life. The small daughter of us is so lovely for us. At present she is living in our family with his son. He has no self income source. For this, considering the future life of her son we “husband and wife” have donated the two small flats (location-holding no.-304 under schedule no.-B, 2nd floor) on the date of 1/2/200 before our all sons and druthers and transferred the said flats. From the date, Murshida Nuzhat have been enjoying the said property.

On the date of 19/2/2000, confirming the above mentioned donation, we ”husband and wife” have executed the affidavit before the Notary Public, Bangladesh, Dhaka in the presence of the witnesses.
