There is total 416 square gauge of land in 07 No. Section, Road No.-08, Plot-07 in Uttara Residential Area under  Dhaka Improvement Trust (DIT), at present-RAJUK. A 6 (six) storied building has been constructed on this land. With 0085.80 ajutangsha of land with the common facilities, a car parking space in the gourd floor and the flat no.-A-1 (size: 1571.36 square feet in the south east side) in the 1st floor have been transferred by this deed.

At least 25 years consecutive description of the transferred land: (the description of the deed of the earnest money when it will be applicable) and the purpose of the transfer, the possession of the property, easement ownership and any mentionable opinion of the transfer (if any):

 

1.

Applied for Allocations:

 

Remembering the name of merciful Allah it is being started to describe this lawful deed, when the husband of the deed giver  applied  to RAJUK for the allotment of Uttara Residential Area  under the lay-out plan of Rajdhani Unnayan Kartipakkha (RAJUK), RAJUK allotted the property by LA Case no.-64-65.

 

Mst. Asia Begum  applied  to RAJUK for the allotment of Uttara Residential Area  under the lay-out plan of Rajdhani Unnayan Kartipakkha (RAJUK) through depositing Tk.30,000/- on the receipt no.-481, date: 29.05.1990.

 

Considering the application of the said person, DIT, at present-RAJUK gave the allotment of the plot no.-21, area of land: 05 katha, sector no.-14 in Uttara Residential Area through the memo no.-RAJUK/Estate/478 on the date of 01.08.1991.

2.

Installment and payment:

 

The deed giver paid the 1st and 2nd installments in against of the said property to RAJUK within fixed time.

 

Mst. Asia Begum paid the 3rd  installments in against of the said property to RAJUK on 18.07.1994.

 

As the deed giver paid all installments in against of the said property to RAJUK, the authorities of RAJUK marked the plot physically and handed over the property to him and RAJUK leased the plot (size: 416 square gauge) to Mrs. Hasna Banu in  the plot no.-07, road no.-08, section-07 in Uttara Residential Area.

 

Then I “Deed Giver-Mrs. Hasna Banu” deposited the money to the concerned authorities after getting the allocation the plots from DIT, at present-RAJUK and then I deposited  the all installments through the bank receipts in RAJUK Building Branch.

Allocation:

 

As the deed giver paid all installments in against of the said property to RAJUK, the authorities of RAJUK marked the plot physically and allocated the scheduled property under “plot no.-08, road no.-01, sector-14 in Uttara Residential Area” to him.

Application for changing the allocation:

 

When Mst. Asia Begum  applied to RAJUK to change the scheduled property under “plot no.-08, road no.-01, sector-14 in Uttara Residential Area”, RAJUK accepted her application and she was reallocated her property under “plot no.-19, area of land: 5 katha 36 square feet or 3636 square feet, sector-13 in Uttara Residential Area” in replace of the scheduled property under “plot no.-08, road no.-01, sector-14 in Uttara Residential Area” through the memo no.-RAJUK/Estate/12 Est, on the date of 03.01.1994.

Registration 

 

When the deed giver applied for the registration and execution the lease deed, DIT, at present-RAJUK  on behalf of Bangladesh Government executed and registered  a lease deed no.-1225, page no.-107-119, volume-38, book-1 on the date of 12.04.1983 in Sadar Sub-Registry Office, Dhaka and in this way, RAJUK executed and executed  the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area to Deed Giver for 99 years.

5.

Handed Over:

 

Then DIT, at present-RAJUK has handed over  the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area to the deed giver and the deed giver took the possession of the plot from RAJUK.

Apply for getting permission for mutation and separation:

 

Being owner of the scheduled land by the absolute sale deed no.-16554 when it is applied to RAJUK to give permission for the mutation and separation for the scheduled property, RAJUK gave him permission for mutation and separation through the memo no.-RAJUK/Estate/60 Est on the date of 24.01.1996.

Mutation and Separation:

 

Being owner of the scheduled land the deed giver filed the separation and mutation case no.-10152/02, date: 10/07/2002 and accordingly he separated and mutated the jot no.-105/33 and accordingly he has been enjoying the government rent and tax.

Agreement with Developer to construct a building:

 

Then the deed giver  executed  an agreement of two parties  on the date of 19/12/2005 with the Md. Abdul Rahim Khan on behalf of Index Development Limited to construct a multi storied building  on the scheduled land. To implement the conditions of the agreement of the two parties the deed giver executed a power of attorney deed no.-22246 on the date of 19/12/2005 in Gulshan Sub-Registry Office on favor of Md. Abdur Rahim Khan, chairman and managing director  of Index Development Limited.

 

 

7.

Applied to RAJUK for permission to appoint attorney/Developer  and building construction

 

When it was applied to get the permission for appointment of the power of attorney to RAJUK,  Assistant Director (Estate), RAJUK  gave the permission to appoint a attorney to Md. Abdur Rahim Khan, Chairman and Managing Director  on behalf of Index Development Limited  to operate the all kinds of development activities  on the scheduled plot by dint of the memo no.-RAJUK/Estate/169Establishment  on the date of 06/03/2006.

 

 

Then I applied to RAJUK to construct a multi storied building on the said land. After getting our application RAJUK gave us approval or passed plan to construct a 6 storied building on the scheduled land.

8.

Plan Pass From RAJUK:

 

Then I “deed executor” passed a plan from RAJUK by dint of memo no.-RAJUK/TDA/3C/796/06/1636 Est: on the date of 17/10/2006. Then constructing a six storied building on the scheduled land I “deed executor” took the gas, water, electricity, sewerage connection and then I handed over the receivable share to the said deed giver.

 

Then RAJUK approved the plan by dint of memo no.-RAJUK/TDA/3C/796/06/1636 Est: on the date of 17/10/2006  to construct a 6 storied building on the scheduled land

9.

Getting Allocation, Utilities Connection and Enjoyment:

 

After getting the allocation of the plot no.-07 (size: 416 square gauge), road no.-08, section-07 in Uttara Residential Area from DIT, at present-RAJUK  on behalf of Bangladesh Government I “Deed Giver” have been paying the rent and tax and submitting the cheque and enjoying the property peacefully even today.

 

According to the joint venture with the developer company we took connection of gas, water, electricity, sewerage line in the building and then I “Deed Giver” have been paying the rent and tax and submitting the cheque and enjoying the property peacefully even today.

Apply to RAJUK to transfer the property to others:

 

When Mst. Asia Begum applied to RAJUK to hand over my property to the deed receiver and accordingly  RAJUK consider the matter and RAJUK instructed her to deposit the transfer fee, service charge  through the RAJUK memo no.-RAJUK/Estate/1408 Est: date: 03.121995.

10.

Getting permission from RAJUK to hand over the property to others:

 

When I applied to RAJUK to hand over my property to the deed receiver and accordingly I have paid the transfer fees in the Janata Bank, RAJUK Building and deposited the copy of deposition, RAJUK has given me permission to handed over my property on favor of deed receiver through the RAJUK memo no.-RAJUK/Estate/6073 Est: date: 22.08.2010.

Conditions following

The conditions which was  issued  through the lease deed no.-3285 on the date of 27.05.1964 by DIT, at present-Rajuk, will be vested on deed receiver.  The conditions will not be changed.  The conditions which was vested on the deed giver, will be vested on the deed receivers from this date. The deed receiver will be liable to follow all conditions of the original lease deed. All conditions of lease deed must be followed by the deed receivers and accordingly he has to submit a undertaking on the lease deed.
