the date of 2.9.58. Gaining the land he has been enjoying the land
peacefully. Then Bangladesh Rail way
acquired the land with other land and then Mrs. Mehesna Khatun got the
compensation from East Pakistan Government. According to the promise of Bangladesh Government he obtained the plot through the memo no.-48-RDD
on the date of 10.9.1973 from Railway
Division and through the memo
no.-227/1RDD on the date of 10.2.1973.
In this circumstance, Mehenessa
Khatun deposited Tk.350/- on 7.2.73
through Bangladesh Bank D/1 in the first installment among total value of Tk.1750/- to Railway
Division.

Being needed cash money
Mehsena Khatun sold the land through registering the sale deed no.-4346 on
16.3.76 and then she left all kinds of
ownership from the scheduled land. Then
Mst. Rafia Khatun was handed over the land through registering a power of attorney deed no.-4345 on 16.3.76
and by this she got the power to
supervise the property and land and he also got the power to give
lease or to transfer the land on behalf of her.
According to the decision of
Bangladesh Government it is ordered to allocate the plot permanently on favor
of the allocatee. Then Railway Division instructed to Mehsena Khatun to register the lease deed through the office memo no.-2478/2 R, DD on
20.9.79. By the virtue of the power of
attorney of Ministry of Public Works and Town Development on 24.9.1979 she
prayed to get approval to execute the
lease deed.

Then it is ordered to executed the power of attorney on favor of Mst. Rafia Khatun through the memo no-309/L on 21.11.79 and ordered to attest it. After considering the written letter on 14.1.80 Mst. Rafia Khatun, Khilagaon Rehabilitation Area-223, Dhaka has been given permission. According to the clause no.-10 of lease deed Mst. Rafiq Khatun was given permission to register the sale deed on favor of Mr. Md. Abdul Razzaque Khadem, Father: Mr. Md. Abdul Kader Khaem, Address: Village: Khorampur, PS-Akhaura, District: Comilla thorugh the memo no.-6/2/H-12/80/461, date: 23.4.1980.

If it is necessary to register a new deed, I “deed donor” and any of my replaced successors will be liable to register a new deed.
It is being mentioned if the description of the deed, any part of the deed is deducted or any kind of error is revealed, I “deed donor” shall remain liable to register and to execute the rectified deed and to amend the error. If the deed receiver face to any loss due to secrecy of any information and true or any kind of false word is revealed about the transferred land, possession of the property, I shall liable to give the compensation and I shall be convicted according to law.

Getting the plot through the memo no.-DIT/BAO/J/84/337(232)-P on the date of 14.02.85 we “deed giver” have paid the security money of Tk.60,667/- to RAJUK and then I have deposited Tk.6667/- on the date of 28.03.85 by the receipt no.-190, Tk.14667/- on the date of 21.03.87 by the receipt no.-196, Tk.12889/- on the date of 24.03.88 by the receipt no.-178, Tk.18060/- on the date of 29.10.86 by the receipt no.-978. Remembering the name of merciful
Allah it is being started to describe this absolute sale deed. Monir Uddin son of Late Habibur Rahman of
Kishoreganj got the allocation through memo no.-3166 of Directorate of
Engineering Division on 14.11.1969 for the plot no.-A/222, area of land: 222
katha.

When Tk.1629.70 was deposited, Monir Uddin deposited Tk.415.61 on 02.5.1973 through the memo no.-D/21,
Tk.415.61 on 02.5.1973 through the memo no.-D/21, Tk.240.62 on 23.5.1974 through the memo no.-C/32, Tk.404.68 on 8.7.1974 through the memo no.-A/F/14, Tk.525/- on 28.7.1975 through the memo no.-Ca/36, to Bangladesh Bank and also deposited some money through the memo no.-1947 RDD on 12.6.1973. When he was enjoying the land the land was registered on favor of him. Then Monir Uddin appointed Josna Begum, husband: Alhajj Rich Uddin Mia, address: Voirab, Upazila: Voirab, District: Mymonshing, recent-Kishoreganj as his attorney through the power of attorney no.-15292 on 17.8.1982 to supervise the scheduled property.
When Josna Begum prayed to Rajuk to sell the land, Rajuk gave her permission to sell the land through the memo no.-7/2-H-1-187 on the date of 7.3.1987. Accordingly she sold the land to the deed givers through the registering the absolute sale deed no.-1179 on the date of 22.3.1987.
Accordingly the deed giver has been enjoying the scheduled land peacefully and without any objection of other.

At present being
needed the cash money I “deed giver” have proposed to sell the below mentioned
scheduled land. Getting my proposal you “deed receiver have been agreed to
purchase the scheduled land. Discussing about the market value of the said land
with you, both of us have decided that the market value of the said land will
be Tk.420,000/- . In this matter
Rajuk gave permission to sell the land
through the memo no.-Branch-8/2-H-1/87/582/1(2) on the date of
21.04.2003. Taking the money of Tk.420,000/-
from you “deed receiver” I “deed donor” have sold the property to you
“deed receiver” by the absolute sale deed and handing over the possession of
the said land to you ‘deed receiver”. I and my all successors have left all
kinds of ownership from the land forever.
From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.
The property has been sold, is not under any liability. Any kind of case has not been filed about the said land in any court and the court has not ceased the property. The said property has not be made requisition or it is not under the acquisition. It is not any vested property. I have not sold the property in the previous time or I have not made any earnest money deed about the land or I have not made any agreement about the land.

If any kind of misleading or secreting of correct information about the interest, possession of the transferred land are revealed in future and for this, any kind of loss is occurred, I “deed donor” shall remain accountable to refund the showed value including the compensation and I shall be convicted for this. Also it is being mentioned and I “deed donor” am promising that the category of the land is right and the displayed khatian by me is not fake. If it is proved that the category of the land has been changed, I shall be convicted for this and I shall be liable to take any kind of penalty.
If any kind of mistaking is revealed in the plot no., khatian no. or description or in the question of the ownership on the below mentioned schedule land, this deed will not be rejected. Rather I “deed donor” and my any of replaced successor will be liable to rectify the mistaking from the deed. If it is necessary to register a new deed, I “deed donor” and any of my replaced successors will be liable to register a new deed.
This lease agreement will be valid till 99 years and the deed receiver will be liable to follow the conditions of this lease deed and his all successors will be liable to follow the condition of the lease deed.
Hereby in my own willing, in my common sense, in my good health, reading the deed, understanding the meanings of it and without any instigation of others I “deed donor” have signed on the deed. End, Date: 28.4.2003AD correspondence to 15th Baishak, 1410BS.
