Remembering the name of merciful Allah it is being started that we are starting this deed of allotment lawfully.  As we have applied to get allotment of a plot in Khilgaon Rehabilitiation under the lay-out plan of Ministry of Housing & Public Works, a plot of 5 katha 10.25 chatak has been allocated on favor of Momtaz Begum in plot no.-B-216.

 

After paying all installments when Momtaz Begum applied to register and to execute a lease deed, a lease deed no.-4566 was executed on favor of Momtaz Begum on 05.08.1995 by the president on behalf of Bangladesh Government.

 

After being owner of the scheduled land, Momtaz Begum recorded her name correctly in city survey.

Then, after constructing a 10 (ten) storied building on the scheduled land she was enjoying the property. When she died, we “first party to forth party” and mother of Sirajul Haque became the owner of the said land. Then we got approval to mutate our names as successors of Momtaz Begum by virtue of memo-Wing-8/2H-61/95/1287 of Development Wing-8 of Ministry of Housing and Public Works. When the property was enjoyed by them, Md. Sirajul Haque died. After his death I “fifth party” as husband successors and we “sixth to eleventh party” as fatherly successors became the owner of the scheduled property. Then we got approval to mutate our names as successors of  Md. Sirajul Islam by virtue of memo-Wing-8/2H-61/95/329 of Development Wing-8 of Ministry of Housing and Public Works. After mutating and separating our names in jot no.-3056, 3057, 3058, 3059 and 3060, we have been enjoying the scheduled property peacefully.

 

At present as it has been inconvenience  to enjoying the property jointly, the parties have taken decision to execute a deed of allocation of the scheduled land. So, to avoid any disturbance, to avoid any dispute we have separated and mutated our shares on the property.

 

I “first party” (a) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 93.070 ajutangsha and land value is Tk.850,000/- and from this property I have got my share “flat no.-9-A, size: 1238 square feet in the 8th floor, flat no.-9-C, size: 1005 square feet in the 8th floor, flat no.-10-B, size: 528 square feet in the 9th floor, total flat size: 2771 square feet” which flat’s value: Tk.41,57,000/-, total value: Tk.50,07,000/-. Then I have handed over the schedule property (b), (c), (d), (e), (f), (g), (h), (i), (j), (k) to 2nd , 3rd , 4th , 5th , 6th , 7th , 8th , 9th , 10th , 11 party. Then I and my all successors have left the ownership from the scheduled property (b), (c), (d), (e), (f), (g), (h), (i), (j), (k).

I “second party” (b) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 93.070 ajutangsha and land value is Tk.850,000/- and from this property I have got my share “flat no.-2-A, size: 619 square feet in the 1st floor, flat no.-7-C, size: 1238 square feet in the 6th floor, flat no.-7-C, size: 1005 square feet in the 6th floor, total flat size: 2862 square feet” which flat’s value: Tk.4293000/-, total value: Tk.51,43,000/-. Then I have handed over the schedule property (a), (c), (d), (e), (f), (g), (h), (i), (j), (k) to 1st  , 3rd , 4th , 5th , 6th , 7th , 8th , 9th , 10th , 11 party. Then I and my all successors have left the ownership from the scheduled property (a), (c), (d), (e), (f), (g), (h), (i), (j), (k).

 

I “third party” (c) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 93.070 ajutangsha and land value is Tk.850,000/- and from this property I have got my share “flat no.-10-A, size: 1238 square feet in the 9th floor, flat no.-10-B, size: 1238 square feet in the 9th floor, flat no.-10-B, size: 528 square feet in the 9th floor, total flat size: 2771 square feet” which flat’s value: Tk.4157000/-, total value: Tk.50,07,000/-. Then I have handed over the schedule property (a), (b), (d), (e), (f), (g), (h), (i), (j), (k) to 1st  , 2nd  , 4th , 5th , 6th , 7th , 8th , 9th , 10th , 11 party. Then I and my all successors have left the ownership from the scheduled property (a), (b), (d), (e), (f), (g), (h), (i), (j), (k).

Then I have handed over the schedule property (a), (b), (c), (d), (f), (g), (h), (i), (j), (k) to 1st  , 2nd  , 3rd  , 4th , 6th , 7th , 8th , 9th , 10th , 11 party. Then I and my all successors have left the ownership from the scheduled property (a), (b), (c), (d), (f), (g), (h), (i), (j), (k).

 

I “sixth party” (f) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 18.097 ajutangsha and land value is Tk. 1,65,000/- and from this property I have got my share “flat no.-8-B, size: 655.05 square feet in the 7th floor, total flat size: 655.05 square feet” which flat’s value: Tk.983000/-, total value: Tk.1148000/-. Then I have handed over the schedule property (a), (b), (c), (d), (e), (g), (h), (i), (j), (k) to 1st  , 2nd  , 3rd  , 4th , 5th , 7th , 8th , 9th , 10th , 11 party. I “tenth party” (j) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 09.0485 ajutangsha and land value is Tk. 82,000/- and from this property I have got my share “flat no.-7-B, size: 280.66 square feet in the 6th floor, which flat’s value: Tk.421000/-, total value: Tk.503000/-. Then I have handed over the schedule property (a), (b), (c), (d), (e), (f), (g), (h), (j), (k) to 1st  , 2nd  , 3rd  , 4th , 5th , 6th , 7th , 8th , 9th  , 11 party. I “eleventh party” (k) have obtained the below mentioned scheduled property on which a 10 storied building has been constructed  which size is 09.0485 ajutangsha and land value is Tk. 82,000/- and from this property I have got my share “flat no.-9-B, size: 280.66 square feet in the 8th floor, which flat’s value: Tk.421000/-, total value: Tk.503000/-. Then I have handed over the schedule property (a), (b), (c), (d), (e), (f), (g), (h), (j) to 1st  , 2nd  , 3rd  , 4th , 5th , 6th , 7th , 8th , 9th , 10th party. Then I and my all successors have left the ownership from the scheduled property (a), (b), (c), (d), (e), (f), (g), (h), (j).

From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts.

It is being mentioned that I “deed donor” have not sold the below mentioned scheduled property even before, have not transferred, have not donated, have not mortgaged and have not made any agreement with others by writing or by verbal.

 

Whereas, a room of 130 square feet on the roof of the building will be a combined property. In this matter any party can not make any bar.  If it is done so, it will be rejected in the all courts.

 

Hereby in my own willing, in my common sense, in my good health, reading the deed, understanding the meanings of it and without any instigation of others I “deed donor” have signed on the deed. End, Date: 27.10.2014 correspondence to 12 Kartik, 1421BS.
