At present being needed the cash money I “deed giver” have proposed to sell the below mentioned scheduled land. Getting my proposal you “deed receiver have been agreed to purchase the scheduled land. Discussing about the market value of the said land with you, both of us have decided that the market value of the said land will be Tk.10,000/- (Ten Thousand taka). Taking the money from you “deed receiver” I “deed donor” have sold the property to you “deed receiver” by the absolute sale deed and handing over the possession of the said land to you ‘deed receiver”. I and my all successors have left all kinds of ownership from the land forever. From this date, you “deed receiver” have been owner of the scheduled land according to purchase and being owner of the scheduled property you “deed receiver’ can issue your name in replace of my name and you can pay government rent and tax and can submit cheque and by this, you “deed receiver” can donate, can sell, can give heba and can mortgage and can transfer and can exchange the property to others and cutting soil from the scheduled land. By this, you and your all kinds of successors can enjoy the property forever and can enjoy the property peacefully. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts. Hereby in my own willing, in my common sense, in my good health, reading the deed, understanding the meanings of it and without any instigation of others I “deed donor” have signed on the deed. EVIDENCE OF CONTRACT TO ALLOT THE HOUSE

This contract has been done on the date of 14th January, 2015AD.  The President of the Government of the People’s Republic of Bangladesh................ First Party  (his successors will be included with him).  And

Nurjahan Begum, Husband: Md. Abdus Salam Sikder. Address: Sector-114, C, 9D-5 Lane-22, 10 Mirpur, Dhaka.

(She will be treated as the second party. The successors and approved appointers will be inclued with this).

 

As the second party has been selected for a house, the first party has given the below mentioned conditions to the second party.  

a)

The scheduled property/land in the mentioned plot has been leased and transferred  for the 99 years.

b)

Then the house has been treated as constructing residential house which will be transferred in the alternative purchase including rent-purchase process.

 

Hereby this contract is bearing the evidence that the first party will hand over the property to the second party under the below mentioned conditions:-

a)

The mentioned place has been leased and transferred for the 99 years.

b)

The constructing house has been transferred in the previous place.

1.

The second party will pay Tk.36/- as the annual land tax about the said place.  There is further conditions if the second party  is willing, this land tax may be paid in equal 12 installments.

2.

The second party can pay Tk.108000/- (One lac and eight thousand taka) for the land development  in the second, third and fourth installment. Beside this, others payable tax as water, sewerage system will be paid by him which will be assessed by the due authorities in the due time.

3.

After paying the entire value of the house the second party will be owner of the house as far as possible. If he fails to pay the interest  including  value of the house, the government may issue the punishable crime. If it is winded up this contract, the lessee will be issued the interest. But the government will assess this rate. If there is any kind of unpaid money, will be collected by the government in the assessed process.

4.

The parties have been agreed according to the condition of this deed that the second party has not been allocated  any residence in Bangladesh. If it is found that the second party has violated this condition, the contract about the lease and house will be cancelled  and  for this the second party will not able to get refund the paid amount.

5.

a) If the second party fails to pay any payable money under this present deed or violates any condition or becomes lazy to obey any instruction of the first party, this contract of lease will be winded up after giving the 30 days notice.

b)After  winding up this lease agreement, the right, possession of the second party on the house and others structure will be vested on the first party under the below mentioned conditions.

A)

If the second party becomes the owner of the said house through the direct purchase, the first party can do any one among the below mentioned two options:-

1.

If the second party have any depreciation-expense, depreciated due of the rent of the said place and others receivable money, will be deducted and then he will be paid the  compensation. Then the first party can possess the said property again.  Or

2.

After taking the possession of the said place again, the first party will order to remove the structure, materials from the said place to the second party within due time. If the second party fails to remove those things, the materials of the second party will be removed by auction.

 

B)

If the house is possessed under the second party without any direct purchase, the first party will give the order to vacate the house within due time.  Accordingly if there is any damage  in the house, the second party will be liable to pay the compensation in the rate assessed by the first party.

a) Without the pre-permission of the  first party, the first party can not dig in the inner side of the house or can not do any change.

 

b) If the second party is seen satisfactory to the first party, he will keep the house in competent position and will repair the house.

 

c) If the second party fails to obey the conditions given under A and B, the first party can remove the second party from the house. On the other hand, he can repair the damage and can collect the expense under his supervision.

Without any permission of the government, the property under the contract, building, house, structure, its any part will not be transferred, sold, exchanged, mortgaged, gifted, rented, sub-let by the second party.

According to the clause no.-8 and conditions of the present deed, the lessee will have power  to transfer, to give sub-let according to his willing. But there is a condition that  the transfer of the property will be registered in the office of authorities appointed  by the lessor. Until this transfer will not be done and registration will not be done, the said property will be treated as the property of the second party. Whereas,  without any permission of the lessor if any kind of transfer is done about the property or any part of the property will be treated cancel and invalid.  But when the lessee will apply for the such kind of transfer, the lessee will be paid the transfer fee. When the successors of him will mutate their names, they will be liable to pay the mutation fee to the lessor.

10.

 

The second party will follow the instructions issued by the first party in time to time and he will be liable to give the permission to enter into the scheduled property to the first party/his representative due to any competent reason.

11.

If the lease is not winded before the fixed time, the agreement will be renewed for the next 33 years.  If the second party is not willing to renew this contract and he is not willing to obey the conditions of the first party, the second party will be liable to hand over the structure, building and others equipments under the scheduled property . If the scheduled property is handed over without any liability, he will not be given any compensation. 

 

But there is a condition, after handing over the schedule  property, the first party can give the permission to the second party to withdraw the entire structure, building and equipments.

12.

Hereby the first party have done this contract that second party will enjoy the property after paying the land tax, others necessary conditions.

13.

The second party will be paid the registration fee and stamp due.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

14.

If any kind of dispute rises  among the parties under the present deed and about the scheduled property (the decision which has been taken without those decision), the dispute matter will be sent to the deputy-commissioner of the  settlement of Ministry of Public Housing under the Government of the People’s Republic of Bangladesh. Or the dispute matter will be sent to the person appointed by the President.  The both parties will be liable to obey the decision of the arbitrator.  In this matter the rules of the Arbitration Act-1940 will be followed and others amended rules will be applicable for this. The expense or related to the expense will be under the justice of the arbitration.
