At present being needed the cash money I “deed giver” have proposed to sell the below mentioned scheduled land. Getting my proposal you “deed receiver have been agreed to purchase the scheduled land. Discussing about the market value of the said land with you, both of us have decided that the market value of the said land will be Tk.25,000/- . Taking the money from you “deed receiver” I “deed donor” have sold the property to you “deed receiver” by the absolute sale deed and handing over the possession of the said land to you ‘deed receiver”. I and my all successors have left all kinds of ownership from the land forever. From this date, you “deed receiver” have been owner of the scheduled land. In this matter I “deed donor” and any of my successors can not make any complain or can not make any objection and can not make any claim. If any kinds of such claim are made by me or by any of my successor it will be rejected and unaccepted in the all courts. Hereby in my own willing, in my common sense, in my good health, reading the deed, understanding the meanings of it and without any instigation of others I “deed donor” have signed on the deed. 02.   The 1st party  has  received   TK. 6,00,000/- (Six Lac ) as  deposit  from the  2nd party    with  free from  usury.

03.   The  monthly  rent fare of that garage  TK. 60,000/-  ( Sixty Thousand) taka  has been  determined  and  date from 01 to 10 of every  English month  will be  paid  to the 1st party.

04.   Electric bill, water bill and others bill will be paid by the 2nd party.

05.    Over again  three times  not pay  the garage rent fare  then will be  deduced  from the  deposit amount  and for  that the 2nd party will not raise up  any objection .

06.   At the  time of sustaining  rent  the  2nd party   would  not conduct  any  illegal   activities in the garage.

07.   At the of  sustaining  rent for any  tiny  repairing  work  will be   done by the  2nd party  and   for  any  construction work   will be  done as permission by the    1st  party.

08.   The 2nd  party  for  any  troublesome  intense  to exile  the garage  will have to inform  before three  months  on written .  Then  both  parties  with negotiation  with be  discharged  of the  agreement   with  returning the deposit  money  to the 2nd  party  by the 1st party.

Remembering the name of merciful Allah it is being started to describe this deed.  When  CS recorded owner namely Baikuntho Nath Saha son of Late Hori Mohon Saha was enjoying the scheudled land, he died keeping his son namely Sree Godadhar Saha.

 

When Sree Godadhadar Saha was enjoying the scheduled land he needed the cash money. Then he sold the land through registering an absolute sale deed no.-5491 on the date of 11.11.1949 in Dhaka Sadar Sub-Registry Office and then he left all kind of ownership from the scheduled land forever.

 

After that, when Sreemoti Chitrabala Sala was enjoying the scheduled land he recorded his name in last SA and RS record correctly and then he sold the land to Sree Balram Saha and Sree Montu Chandra Saha through registering a deed no.-11154 on the date of 17.04.1974.

 

After that  Sree Balram Saha and Sree Montu Chandra Saha were enjoying the scheduled land peacefully and in that time they needed the cash money.

On previous  16/ 11/ 1994AD,  in Keraniganj  sub registry office,  as registry  deed  no-  8287   sold to  Sultan Madmood   and  being dispossessed  from the possession  forever.

 

Thereafter  the following schedule land   of being possessed  by Sultan Mahmood  as  absolute purchaser   and necessary of cash money  on last  22/ 07/  1997 AD,  in Keranigang  sub-registry office  as registry no-  5315  sold   to  Dr.  Sirajul Islam  and being dispossessed from  the possession forever.

 

Thereafter  the said  schedule   land of being possessed   by Sirajul Islam  as purchaser   and mutated  and distributed  to record the name  as correctly  and died  at the time of possessing  and  to his remained   land  we the  deed  givers of being   possessors  as  successors.

 

On the said   ways  the mentioned schedule land  we the  01 and 02  deed  givers  as successor   of late   husband  Sirajul Islam  and we  from 03  to 06  no deed givers as  late father  Sirajul Islam  of being possessors as  successors   and mutated  and  distributed  as correctly in the own name   as  case no-  1285/16-17,on the date  of 24/ 10/ 2016 AD,  and as possession  no- 5427)  of  being  sustain the possession  for  the duration    with peace  without  others  objections and obstacles.

It is being mentioned that I “deed donor” have not sold the below mentioned scheduled property even before, can not transfer, can not donate, can not mortgage and can not make any agreement with others by writing or by verbal. I can not mortgage the property to others or to any bank and I can not make any earnest money deed with others and the scheduled property has not been made auction and has not been forfeited.  The below mentioned scheduled property has been sold by absolute sale deed when the property was correct without any error and without any liability. If any kind of error in the absolute sale deed is revealed in future, the deed will not be rejected or will not be abolished. Rather, if it is needed, I shall remain liable to execute and to register a new rectified deed under my responsibility and the error rectified deed will be considered as part of the absolute sale deed.
